Terms of Service

1. General Provisions
These Terms of Service (hereinafter — "Terms") govern the relationship between Viktorija Lekavičienė, operating under individual business activity (registration no. IV_NUMBER), trading as "Welepix" (hereinafter — "Service Provider") and the person using the platform welepix.com (hereinafter — "User").
By registering on the platform, the User confirms they have read and agree to these Terms.
2. Services
Welepix provides the following services:
Photo and file upload and storage in cloud storage.
Client gallery creation, management, and sharing with clients via secure links.
Photo selection — clients can browse and select their favourite photos.
Long-term file storage with folder and subfolder structure.
Archiving — file transfer from gallery to long-term storage.
Client communication via email, WhatsApp, and Viber.
3. Registration and Account
User must provide accurate registration information.
User is responsible for account security and credential confidentiality.
One person may have only one account.
Service Provider reserves the right to suspend, restrict or terminate an account if the User violates these Terms or the fair use policy.
4. Subscriptions and Payments
Services are provided on a prepaid subscription basis. User may choose a subscription period (e.g., 1, 3, 6 or 12 months).
The subscription takes effect from the moment of payment and is valid for the chosen period.
Payments are made by bank transfer or via Paysera payment system. Invoice is issued after order confirmation.
Invoice must be paid within 3 business days. If not paid on time, the subscription will not be activated.
When the subscription period ends, services are automatically suspended if the subscription is not renewed.
During suspension:
— User can no longer access galleries and other platform features
— Files are kept for 30 days from the end of the subscription
If the subscription is not renewed within this 30-day period:
— User's account may be terminated
— All files are permanently deleted
If the subscription is renewed within the 30-day period, services are restored and files remain accessible.
Service Provider does not commit to storing data beyond the stated 30-day period after subscription ends.
5. Plan Changes
Upgrade: the new plan is activated immediately. The fee is recalculated proportionally — User pays the difference for the remaining days of the month.
Downgrade: allowed once every 30 days, only if used space fits within the new plan's limit. Remaining credit is carried forward — the new plan is extended by additional days.
After downgrade: next downgrade available after 30 days. Upgrade available after 24 hours from downgrade.
Cancellation: User may cancel their subscription at any time. Services remain active until the end of the paid period.
6. Vacation Mode
User may activate vacation mode for the Gallery subscription. During vacation, gallery functionality is paused, but files remain safe.
A reduced fee applies during vacation, calculated based on storage used.
Cancelling vacation mode earlier than planned may incur a compensation fee.
Upon returning from vacation, all files and galleries are fully functional again.
7. Expansion Plans
User may purchase additional storage blocks (+50GB for Gallery, +250GB for Storage).
Expansion plans require a qualifying base plan (e.g., +50GB requires the Max plan).
Expansion plans have a separate monthly price. The same downgrade rules apply as for base plans.
8. Refund Policy
Welepix provides digital services that begin immediately upon payment.
No refunds are issued for subscription periods that have already begun.
By registering and ordering a subscription, the User agrees that the service begins immediately and waives the right to withdraw within the 14-day period provided by EU Consumer Rights Directive 2011/83/EU.
When downgrading, remaining credit is used to extend the new plan, not refunded as money.

9. Fair Use Policy
Gallery is an active workspace designed for uploading, viewing and sharing photos with clients. It is not intended for continuous intensive data uploading, deleting or automated cyclical file processing.
Gallery plans include reasonable usage, including file uploads, viewing and downloads, but do not cover a disproportionately large volume of operations.
Usage is considered disproportionate if within a 30-day period:
— the volume of uploaded and/or deleted data significantly exceeds the plan capacity (e.g., more than 3–5 times the plan size), or
— an unusually high number of file operations is performed (e.g., mass or continuous uploading, deleting, overwriting) that does not match a typical photographer's workflow.
The following may be considered fair use violations:
— Systematic cyclical uploading and deleting of files to circumvent plan capacity.
— An unusually high volume of file operations (uploads, deletions, views or downloads).
— Automated or programmatic usage generating an excessive number of requests without Service Provider's consent.
Service Provider reserves the right to evaluate usage individually, taking into account the volume of operations, data throughput and usage patterns.
To ensure platform stability and fair usage for all Users, technical restrictions may be applied, including request rate limiting or operation volume limits.
In case of violation, Service Provider may:
(a) contact the User and suggest a more suitable plan;
(b) temporarily restrict certain features (e.g., uploading or deleting);
(c) apply additional charges for excessive usage;
(d) in extreme cases — suspend or terminate the account.
10. User Content
User retains all copyrights to uploaded content.
User guarantees they have the right to upload and share content through the platform.
Uploading illegal, copyright-infringing, or otherwise prohibited content is forbidden.
Service Provider does not review uploaded content but reserves the right to remove content that violates these Terms.
11. Data Storage and Deletion
Files are stored as long as the subscription is active.
After the subscription ends, files are kept for a 30-day period. During this period, the User may renew the subscription and restore access to files.
After the 30-day period, all files are permanently deleted and the account may be terminated.
Storage (long_term) files have a minimum 90-day retention period — files cannot be deleted during this period.
User may delete files at any time through the platform (except for stated restrictions).
User is responsible for making backups. Welepix is not considered the sole or guaranteed data storage location.
12. Service Availability
Service Provider aims to ensure stable and uninterrupted platform operation, but does not guarantee that services will operate without disruptions or interruptions.
Maintenance may be performed at any time, and where possible, Users will be notified in advance.
Service Provider is not responsible for service disruptions or unavailability arising from third-party infrastructure (cloud storage, CDN network, payment systems) or other causes beyond Service Provider's control.
Services may be temporarily unavailable due to technical updates, system changes or unforeseen circumstances.
13. Limitation of Liability
Service Provider is not liable for losses arising from User's actions or inactions.
Service Provider is not liable for data loss arising from technical disruptions, third-party infrastructure operation, User actions or force majeure circumstances.
Maximum liability in any case does not exceed the amount paid by the User in the last 3 months.
Service Provider does not guarantee the platform will operate without errors or interruptions.
14. Intellectual Property
The platform, design, code, and "Welepix" trademark belong to the Service Provider.
User does not acquire any rights to the platform's software or design.
15. Changes to Terms
Service Provider may modify these Terms. Users will be notified of significant changes by email no later than 30 days before the changes take effect.
Continued use of the platform after changes take effect constitutes acceptance of the new Terms.
16. Dispute Resolution
These Terms are governed by Lithuanian law. Disputes are resolved in Lithuanian courts.
Consumers may contact the State Consumer Rights Protection Authority (vvtat.lrv.lt) or use the EU dispute resolution platform (ec.europa.eu/odr).
17. Data Processing (DPA)
When the User uploads content (e.g., photos featuring identifiable persons), the User acts as the data controller. In such cases, Welepix acts as the data processor and processes data solely on the User's instructions and within the scope defined in these Terms.
Welepix engages the following sub-processors to ensure platform operation: cloud storage providers, content delivery network (CDN), payment processing and email delivery service providers. All sub-processors are selected to ensure compliance with GDPR requirements.
In the event of a data security incident, Welepix commits to notifying affected Users no later than 72 hours from the moment the incident is identified.
Upon subscription termination or account deletion, all User-related data is deleted according to the timelines specified in these Terms (Section 11). The User may request data deletion at any time by contacting [email protected].
